Dallas, TX asked in Criminal Law, Military Law and Traffic Tickets for Texas

Q: Court for failure to comply with ignition order in TX; no legal advice received.

I've been unable to maintain my job due to an incident that occurred before I could swear into the army. Consequently, I couldn't pay for Intoxalock's calibration, though I've informed my pre-trial officer about this issue. Despite being in compliance with my bond conditions since release, I'm currently stuck in Texas as I await a court date in Denton County for failure to comply with an ignition interlock order, which is to be heard in Lewisville Municipal Court. I haven't received any legal advice on how to handle this court appearance. What will happen with my situation?

A: Your upcoming court date in Lewisville Municipal Court for failure to comply with an ignition interlock order is serious, but it can be managed—especially if you’ve stayed in touch with your pre-trial officer and have documentation of your financial hardship. Courts in Texas understand that life circumstances can make compliance difficult, but they also expect you to appear, explain the situation clearly, and show that you’re making efforts to correct the issue.

When you appear in court, be ready to show proof of your efforts—communication with Intoxalock, notices to your pre-trial officer, and any job loss documentation. Judges often consider these factors when deciding whether to impose penalties or allow extra time to get into compliance. If this is your first noncompliance and your bond conditions have otherwise been met, the court may be willing to work with you, especially if you can outline a realistic plan to resolve the calibration issue.

Do not skip the hearing. Failing to appear or being unprepared can result in a warrant, bond revocation, or additional restrictions. You need to show the court that you’re acting in good faith despite the obstacles. This is your chance to regain control of the situation and avoid further consequences.
