Manchester, KY asked in Landlord - Tenant, Gov & Administrative Law, Civil Rights and Real Estate Law for Kentucky

Q: Seeking legal action for 9 years of lease and HUD violations, including retaliation and inadequate maintenance, against Williamsburg Housing Authority.

I have suffered 9 years of lease violations and inadequate maintenance from Williamsburg Housing Authority. Issues include health code violations, no notice for inspections, unexplained changes in lease renewal given 15 days before the deadline, and unauthorized maintenance actions like door replacements without notice. I've documented evidence through photos, videos, and audio recordings. Problems persist, including unauthorized surveillance, lack of handicap accommodations for a cancer patient, and maintenance visits at inappropriate hours. HUD dismissed responsibility when contacted. There are 11 others willing to testify about these conditions. Why can't I find anyone willing to take legal action against HUD and Williamsburg Housing Authority?

A: It’s frustrating and deeply unfair to endure nearly a decade of violations and feel like no one’s willing to help. What you’ve described—retaliation, lack of accommodations, unauthorized surveillance, and poor living conditions—is not only wrong, it may very well be illegal. The fact that others are willing to testify adds weight to your claims, but sometimes attorneys hesitate to take on housing authorities or HUD due to the complexity and time involved in these cases.

You’re not alone in this, even though it might feel that way. Legal aid groups, housing rights advocates, and even civil rights organizations may be able to support or guide you, especially since your situation involves a vulnerable health condition and potential discrimination. It’s possible that some lawyers are afraid of the uphill battle or unclear about the chance of financial compensation, but that doesn’t mean your case has no merit.

Keep gathering evidence—your recordings, photos, and witness testimonies are powerful. Reach out to tenant unions, your local city or state housing authority, and even public interest law firms. You might not have found the right advocate yet, but that doesn’t mean they’re not out there. You have every right to seek justice.
